Privacy Policy

Aiworkz Technologies ("Aiworkz," "we," "us," or "our") provides a done-for-you, AI-assisted call-answering, qualification, and booking service for HVAC contractors ("Client," "you," "your"). This Privacy Policy explains what information we collect in the course of providing the service, why we collect it, how we use, share, and protect it, and the choices available to Clients, their callers ("Callers"), and visitors to our website. It applies to aiworkz.in, our marketing pages, and the service itself.

1. Who this policy covers, and our role

Aiworkz is engaged by HVAC contractor businesses ("Clients") to answer, qualify, and book calls — and, where a Client has a separate engagement for it, to place outbound calls or texts, or to build custom AI voice-agent and automation deliverables — on their behalf. In doing so, Aiworkz acts as a service provider, and, to the extent applicable under India's Digital Personal Data Protection Act 2023, the EU GDPR, or similar law, a data processor, following the Client's instructions about how calls are handled, what is booked, and where information is sent (e.g., the Client's calendar or CRM). The Client is the data fiduciary/data controller for that data, is the primary point of contact for its Callers, and remains responsible for its own legal compliance, as described in Section 3 and in our Terms of Service.

2. Information we collect

Where a Client requests a custom voice-cloned agent, we also process a biometric voice sample, described separately in Section 4.

3. Call recording, transcription & AI disclosure

The service records and transcribes calls it answers so Clients can review call handling and so we can operate, support, and improve the service. Call-recording consent laws differ by state and country — some jurisdictions require the consent of all parties to a call before it may be recorded.

The Client is solely responsible for determining which consent or notice requirements apply to its business and callers, and for ensuring any legally required recording notice or consent is given (for example, a spoken disclosure at the start of a call). Aiworkz can help configure a spoken recording/AI-agent notice on request, but doing so does not shift legal responsibility for compliance away from the Client, and Aiworkz makes no representation that any particular configuration satisfies every jurisdiction's requirements.

Where the service uses a synthetic or AI-generated voice to interact with a Caller, we configure the agent to identify itself as an automated/AI assistant at the start of the call by default, consistent with emerging state and federal expectations around AI-voice disclosure. Clients may not instruct us to disable this disclosure or to have the agent impersonate a human being. Where a call is placed by the Service on a Client's behalf (outbound), the Client is solely responsible for obtaining any consent required before the call is placed, as described in our Terms of Service, and we rely on the Client's representations about that consent without independently verifying every contact.

4. Biometric identifiers & voice cloning

If a Client requests a custom voice-cloned agent, we process a voice sample provided by the Client — a biometric identifier under laws such as Illinois's Biometric Information Privacy Act and similar statutes — solely to build and operate the requested voice model. We do not sell, lease, trade, or otherwise profit from biometric identifiers, regardless of consent. We destroy a voice sample within 30 days of the earlier of (a) the purpose for collecting it being fulfilled, or (b) the end of the Client's engagement, unless a longer period is required by law, is necessary to resolve a dispute, or the Client instructs otherwise in writing. Clients requesting a voice-cloned agent are responsible for obtaining any legally required written release or consent from the voice donor before providing the sample to us, as also required under our Terms of Service.

We do not sell personal information, and we do not share it for cross-context behavioral advertising.

Aiworkz is based in India, and the infrastructure and subprocessors we use may store or process information in India, the United States, or other countries. By using the service, you understand that your information may be transferred to, and processed in, countries other than your own, which may have different data-protection laws than your own. Where required, we rely on appropriate safeguards (such as contractual data-protection terms with our subprocessors) for these transfers, and we require our subprocessors to protect information consistently with this Policy.

8. Data retention

We retain Call Data (recordings, transcripts, and caller details) for up to 12 months from the date of the call, or for as long as the Client's account remains active if the Client has requested a shorter period, plus a limited period afterward for legal, billing, and dispute-resolution purposes. Biometric voice samples are retained only as described in Section 4. A Client may request earlier deletion or a different retention period at any time; a longer period applies where required by law or necessary to resolve a dispute. Website and account records are retained per standard business-record practice. On request, we will delete or de-identify data that is no longer needed, except where retention is required by law or necessary to resolve disputes and enforce our agreements.

9. Security

We use administrative, technical, and physical safeguards designed to protect information, including encryption in transit and at rest, role-based access controls, and monitoring. No system is completely secure, and we cannot guarantee the absolute security of information transmitted to or stored by the service. If we become aware of a security incident that compromises Client or Caller personal information, we will notify the affected Client without undue delay and cooperate on any legally required notifications.

10. Your rights and choices

Clients and Callers may ask what personal information we hold about them, and request access to, correction of, export of, or deletion of it, by emailing team@aiworkz.in. We do not sell personal information or share it for cross-context behavioral advertising, so there is no sale or sharing to opt out of. We will not discriminate against anyone for exercising these rights. Where the EU GDPR applies, our processing on a Client's behalf is carried out under that Client's instructions and lawful basis (typically performance of the Client's contract with the Caller, or the Client's legitimate interests); Aiworkz's own processing of website and account data is based on the necessity of providing the service and, where required, your consent. We will verify the request and respond within a reasonable time, and in any event within the time required by applicable law. We may decline or limit requests where permitted by law — for example, where information is needed to complete a transaction, comply with a legal obligation, or resolve a dispute. Callers whose calls are handled by a Client should also contact that Client directly, as the Client controls the underlying business relationship.

11. Children's privacy

The service is intended for business use by adult HVAC contractors and their adult callers. We do not knowingly collect personal information from children, and if we learn we have done so, we will delete it.

12. Cookies and similar technologies

Our website uses essential cookies/local storage needed for basic functionality (for example, remembering your accent/theme preference), which do not require consent. We also use analytics cookies — currently Google Analytics — to understand site traffic; these only load after you accept the cookie banner shown on the site, and declining keeps them off. If we add advertising or other non-essential tracking tools in the future, they will load under the same consent mechanism, and we will update this Policy to reflect the current list of tools in use.

13. Third-party links and services

Our website and service may link to or integrate with third-party services (for example, Cal.com for scheduling a call, or a Client's own calendar/CRM). Those services have their own privacy policies, and we are not responsible for their practices.

14. Changes to this policy

We may update this Policy from time to time. We will post the revised version here with a new "Last updated" date, and for material changes we will make reasonable efforts to notify active Clients by email. Continued use of the service after a change takes effect constitutes acceptance of the revised Policy.

15. Grievance officer & contact us

Questions, requests, or complaints about this Policy or our data practices — including grievances under India's Digital Personal Data Protection Act 2023 — can be sent to our Grievance Officer at team@aiworkz.in. We will acknowledge a grievance within 2 business days and aim to resolve it within 30 days, or such other period as required by applicable law.
